CONTAINER GROWN PLANTS

KORDES®/NEWFLORA® ROSE VARIETIES
GROWER’S LICENSE AGREEMENT



By accepting this order, and/or unpacking these plants which are protected by patents and/or trademarks held by Kordes® Roses and Newflora® LLC, you, the customer shown on the shipping documents receiving this order (hereinafter "Licensee") accept the terms and conditions below. If you do not agree to the terms of this agreement, do not accept this order, and do not unpack the order. If this order is refused, promptly contact your sales representative and supplier.

This one-time License is for GROWING FINISHED PLANTS ONLY -- Licensor hereby grants to Licensee a non-exclusive license only to grow into and sell as Finished Plants ("Finished Plants" is defined as plants that have reached a size and appearance appropriate for retail sale) the Licensed Plant Material hereby delivered to Licensee. Licensee agrees to not propagate any of the plants in this shipment.
ANY AND ALL FORMS OF PROPAGATION BY THE LICENSEE OF THESE PLANTS BY ANY AND ALL MEANS ARE STRICTLY PROHIBITED.


All plants in leaf shipped to retailers and customers in the North American market shall:

  • Be disease and pest free

  • Have a well-developed root system that fills the container

  • Be of uniform growth and with an abundance of foliage

  • Have a pre-approved plant label affixed to the plant

  • Be grown in an appropriate pot size for the collection’s requirements. The minimum finished pot size for the following collections are:


Kordes® Rose Collection

Minimum Finished Container Size (ANSI Z60.1-2014) **

Citiscape®, Kolorscape®, Vigorosa®, and Veranda®

1 Gallon Nursery Pot

Arborose®, Eleganza®, Parfuma® and Sunbelt®

2 Gallon Nursery Pot

Any other Kordes® rose variety not listed in these collections

1 Gallon Nursery Pot


** Unless the supplier is granted written permission from Newflora LLC for alternate minimum pot standards.

The objective of these minimum standards is to help insure that retail customers receive plants that will grow and establish and perform in the multitude of garden environments in North America.
